Trust Governance
The "No-State" Solution proposes a new form of government that can be created in lands experiencing disagreement or war regarding control thereof by the parties to the dispute as an alternative to nationhood.
Trust Governance draws on the essential elements of the trust (which holds and administers an estate for the benefit of its beneficiaries), to construct a modified irrevocable trust to hold disputed lands for the benefit of the people, which is administered by both the original parties to the conflict (those that claims sacred right and connection with the land) as "Interested" Grantors and Trustees; "Independent" Trustees are selected by the original Grantors to assist in the administration of the Trust Governance, who can offer stability and impartiality (as individuals not claiming a sacred right and connection with the land), as well as invest knowledge and experience valuable to the particular region and its unique features for the benefit of the beneficiaries, the people, within their Independent Trusteeships.
The paper from which the concept is first proposed in forthcoming in the Indonesian Journal of International & Comparative Law.
Unbounded Law
Undergirding Trust Governance are the principles of Unbounded Law, emphasizing: relationships over ownership; people over country; celebration of common good over law focused on its aberrations and resulting punishment; and recognition of the value, and harnessing of the power inherent, in unity over the degradation that separation based on difference can foster.
Unbounded Law is peace architecture, emphasizing collaboration, harmony, profound respect, selfless service, and upholding stability, safety, self-determination and equal rights for all people. It is a government for the people, for peace, and for celebrating our differences and the sacred facets of being that connect us to land and each other.
Consultancy
Unbounded Law seeks to provide consultancy services to lands in conflict at the parties' discretion, and with the complete consent of those parties. Founder, Sofia Collin, is not a licensed attorney, but would work with attorneys licensed in the land's respective jurisdictions and internationally recognized attorneys, to cultivate a Trust Governance that identifies, celebrates, and supports all parties involved, ultimately for the benefit of the land's citizens.
Contact Sofia Collin at: UnboundedLaw@gmail.com if you are a party to a disputed land who wishes to learn more about Trust Governance, and to discuss whether Ms. Collin can be of assistance in the drafting process.
